Kimberly Anne Capadona advises clients on all aspects of employment law and labor relations, and provides counseling with respect to human resources issues. Her broad range of experience includes nationwide representation of employers in cases alleging all types of discrimination and harassment claims; violation of family leave, equal pay, pregnancy, whistleblower and wage and hour statutes; violation of collective bargaining agreements and employment contracts; and violation of other public policy and common law tort claims. She has regularly represented management in insurance-covered litigation and is well-versed in the various issues that arise in such litigation.

In addition to her litigation practice, Ms. Capadona regularly advises in-house counsel, human resource managers and risk management professionals on federal and state labor and employment laws. She frequently assists such professionals in establishing and implementing policies, procedures and decisions regarding all aspects of the employment relationship, including hiring, firing, promotions, compensation, leaves and reasonable accommodations. She also assists in developing employee handbooks and policies, employment contracts, and non-competition and separation agreements.

Ms. Capadona has managed directors’ and officers’ liability matters for major international businesses. She has also been extensively involved in insurance coverage disputes, including domestic and foreign arbitrations.

Ms. Capadona graduated from Seton Hall University, magna cum laude, in 1998, and earned her Juris Doctor degree from Seton Hall University School of Law in 2001. Her publications include an article entitled, The Scope of Title IX Protection Gains Yardage as Courts Continue to Tackle the Contact Sports Exception, in the Seton Hall Journal of Sport Law (10 Seton Hall J. Sport L. 415 (2000)). She has served as a guest lecturer for various classes in the area of labor and employment law. A member of the American Bar Association and the New Jersey State Bar Association, Ms. Capadona is admitted to practice in the State of New Jersey, and before the United States District Court for the District of New Jersey and United States Court of Appeals for the Third Circuit.
