Daniel Y. Gielchinsky
Daniel Y. Gielchinsky serves Herten Burstein in
the area of commercial, chancery, civil, and bankruptcy litigation
and in matters relating to land use.
Mr. Gielchinsky regularly appears before various
Trial courts in connection with Trials, argument of motions, and
conferences. Mr. Gielchinsky enhances the firm's business practice
with his experience in advising individual and corporate clientele
in a variety of bankruptcy related matters. He has successfully
litigated shareholder disputes, employment issues, business
valuation, securities, real estate, commercial, preferential
transfer and class action cases. His finance degree and background
at a financial services company provide him with a strong business
orientation and working knowledge of these issues to better serve
the needs of our business clientele.
Mr. Gielchinsky regularly appears before municipal
Planning and Zoning Boards of Adjustment to obtain variances and
other forms of zoning relief for a variety of residential,
commercial, office and mixed-use projects. He serves the firm’s real
estate clients in a number of capacities, including litigation,
property development, condominium law and local, state and federal
regulatory aspects.
While Mr. Gielchinsky is a capable and determined
litigator, he utilizes various alternative dispute resolution
techniques in his practice. He knows how to use out-of-the-box
thinking and different solutions to reach a cost-effective goal.
Mr. Gielchinsky is a 1998 graduate of Yeshiva
University, where he earned a B.S. degree in Finance and an A.A. in
Judaic Studies. He received his J.D. with a concentration in
Corporate Law from the Benjamin N. Cardozo School of Law in 2001,
having appeared on the Dean's List for every term of his law school
education. He is admitted to practice before the United States
Supreme Court, the United States Court of Appeals for the Second and
Third Circuits, the United States District Courts for the District
of New Jersey and the Eastern and Southern Districts of New York, as
well as the New Jersey Superior Court and the New York Supreme
Court. Mr. Gielchinsky has also been admitted to the Bankruptcy
Court for the District of Delaware for limited engagements.
An Honorable Morris Pashman Inn of Court Pupil
from 2002 to 2004, and a Barrister during the 2004 to 2006 session,
Daniel is continuing his role as a Barrister for the 2006
to 2008 session, where he continues to hone his trial advocacy
skills and provide pupilage for younger attorneys. He is a member of
the Bergen County Bar Association, General Equity and Land Use
Committees and the New Jersey State Bar Association. Mr. Gielchinsky
is also an active Young Leadership member of the American-Israel
Political Affairs Committee.
