LABOR & EMPLOYMENT

The potential for litigation related to employment matters is minimized when a company has the foresight to establish comprehensive policies and practices as a preventive strategy. Our labor lawyers and employment lawyers help clients put those vital procedures in place.

The Labor and Employment group of Herten Burstein is involved in all facets of the employer-employee relationship, providing services to employer clients that are widely diverse in size and nature. These include large national and international companies, both publicly traded and privately held, not-for-profit, financial, and healthcare institutions, municipalities and other public-sector employers, healthcare practitioners, and small entrepreneurial businesses.

Our labor lawyers are experienced in handling traditional labor law matters, such as practice under the National Labor Relations Act and before the National Labor Relations Board (NLRB) and Public Employment Relations Commission (PERC). Our expertise includes union organizing attempts, unfair labor practice matters, grievance arbitrations, and collective bargaining negotiations.

In the area of employment law, we provide counsel on wage and hour issues, matters involving wrongful termination and workforce reduction, and compliance with federal and state laws, including Title VII of the Civil Rights Act of 1964 and state employment discrimination laws, the Age Discrimination in Employment Act (ADEA), the Americans with Disabilities Act (ADA), and the New Jersey Law Against Discrimination (NJLAD). We are fully qualified to litigate matters relating to these statutes in federal and state courts across the country.

When labor and employment matters proceed to litigation, arbitration or other proceedings, our labor and employment lawyers work together with our litigators to protect the rights and interests of our clients.

The potential for litigation is reduced when sound employment policies are in place and supervisors have reference to a well-developed employee manual. Herten Burstein labor and employment lawyers assist clients in developing these documents, policies and practices, and also provide in-service seminars for employers to enhance supervisory skills. Training sessions include matters relating to harassment law, such as protected classifications, raising awareness, handling complaints, and investigations. The group also provides negotiations training.
