Herten Burstein handles all aspects of real estate and land use law. The lawyers in our real estate practice group have extensive experience dealing with complex, state of the art transactions. Our lawyers appreciate the challenges inherent in both the upturns and downturns of the economy and have the experience to advise our clients on a broad range of real estate and land use issues.

We represent some of the largest real estate developers and investors in New Jersey and New York. Our clients include:

  • Investors in all aspects of commercial and residential real estate.
  • Developers of office buildings, condominiums, shopping centers, hotels, healthcare facilities, co-ops, and mixed used developments.
  • Owners of multi-family developments.
  • Condominium owners’ associations, real estate brokers, architects, building contractors, and mortgage bankers.
  • Planning and zoning boards and municipal governments.

Some of the routine transactional work carried forward by our lawyers include lease negotiations, purchase and sale agreements, preparation of condominium and co-operative documents, negotiation of reciprocal easement agreements in connection with multiple owner property acquisitions, preparing, filing and processing paperwork for land use and zoning transactions before appropriate municipal governmental agencies, such as the planning board and zoning board, developing strategies for environmentally compromised properties in connection with acquisition and sale thereof, working with state and municipal governments to address all real estate and land use issues relating to real estate matters.

In conjunction with our Commercial Lending group, we represent banks and other institutional lenders involved in financing, participations, inter-bank transactions, joint ventures, and investments in real estate transactions. Our representation of financial institutions enables our lawyers to help our clients obtain appropriate financing for their real estate transactions.

The size of our firm allows our real estate and land use lawyers to call on lawyers in other practice groups, such as corporate, tax, bankruptcy and creditors’ rights, litigation and environmental, to help address any issues that may arise. Moreover, given our broad-based commercial litigation group, in the event a deal unwinds, strategies and problem-solving techniques can be used to protect the rights of our clients.
