- The Superior Court, Appellate
Division, on April 21, reversed a trial judge’s decision in a
land use/zoning case argued to the court by Member Andrew Fede
and presented to the planning board by Member Richard Jon
Contant. The appeals court sustained our position, and that of
the planning board, that our client’s application did not
require use variances to permit the use of a small portion of
adjacent property for a driveway that was necessary for access
to the property for which we obtained the land use approvals for
a new hotel. The property next to the hotel contains a
nonconforming use, but the appellate court found that the
proposed driveway was not an impermissible expansion of the
nonconforming use, and that it did not create a second principal
use that required a variance.
- The Federal District Court upheld a
decision of the New Jersey Bankruptcy Court that had been
appealed. The case involves a finding of fraud by a former
attorney who had wrongfully misappropriated her client’s trust
fund monies. In a case tried by member Michael Lubin in Superior
Court, a number of findings had been made concerning the
attorney’s fraud and misappropriation. After the Superior Court
entered judgment against the former attorney, she filed for
bankruptcy protection. Member Daniel Gielchinsky filed a Summary
Judgment motion in Bankruptcy Court asking that the court find
that the now disbarred attorney should be precluded from
re-litigating the issues that had been decided in State Court.
The Bankruptcy Court ruled in our client’s favor, and determined
that the fraudulent misappropriation was a non-dischargeable
debt, and therefore excepted from bankruptcy protection. The
former attorney appealed to the District Court, and the decision
was affirmed.
- Member Gianfranco A. Pietrafesa
coordinated and moderated the annual Business Law Symposium
co-sponsored by the Business Law Section of the New Jersey State
Bar Association. The Symposium was held on April 9 and was
attended by more than 165 business lawyers.
- Member Albert Burstein received a certificate from the
Bergen County Bar Association at its annual dinner,
acknowledging the 60th anniversary of his admission to the bar.

- Herten Burstein has created a new Executive Committee whose
function is to consider and advance both long-term policy
recommendations and major financial solutions affecting the
growth and well-being of the firm. The Executive Committee is
comprised of members Andrew Cevasco, Patrick Papalia and Steven
Harz. Mr. Harz has been named the firm’s new Managing Member,
succeeding Mr. Cevasco, who was the firm’s Managing Member for
the past 15 years. Mr. Harz is recognized as one of New Jersey's
foremost labor and employment practitioners. He heads Herten
Burstein’s Labor & Employment Group.
- Herten Burstein announced that Gianfranco Pietrafesa has
become Chairman of the firm’s Corporate Department. Mr.
Pietrafesa has been a director of the Business Law Section of
the New Jersey State Bar Association, and currently serves as
its Secretary.
- Labor and Employment Associate Dan Ritson has been appointed
as a co-chair of the Meadowlands Regional Chamber of Commerce’s
Small Business Council for 2010. The Small Business Council is
one of the Meadowlands Regional Chamber of Commerce’s top
strategic initiatives for 2010.
- Terry Paul Bottinelli, a member of Herten Burstein’s
Litigation Department, has received the Stivale D’Italia
Award of Excellence, given annually by The Italian Tribune
to a select group of Italian-Americans who have honored their
heritage, culture and traditions.
